We understand that certain situations may necessitate a confidential approach, and this policy document serves to reassure our employees that they can take action without fear of facing any adverse consequences.

Our primary goal in implementing this policy is to foster an environment where employees feel empowered and supported in addressing significant concerns within the childcare setting, rather than letting issues linger or burden their minds.

This policy addresses situations that encompass a wide range of activities, including but not limited to instances involving illegal, immoral, illicit, unsafe, or fraudulent activities within the business.

The intention of this Policy is to: #

  • Foster a secure environment that encourages staff to confidently voice their concerns.
  • Establish transparent procedures for addressing and investigating raised concerns within our company.
  • Clearly outline the terms “Malpractice,” “Maladministration,” and “Whistleblowing” to ensure a common understanding among all employees.
  • Provide guidance to our staff on the steps they should take if they feel apprehensive about raising concerns directly with the company.
  • Encourage and enable individuals to raise genuine and legitimate concerns

Definition of Malpractice #

Malpractice refers to any deliberate, negligent, or inappropriate action or behaviour that deviates from accepted standards, regulations, or ethical guidelines and can potentially harm the safety, well-being, or development of the children under the nursery’s care. Malpractice in a children’s nursery may include actions such as neglecting supervision, failing to maintain proper health and safety measures, engaging in harmful or abusive behaviour, or any other conduct that jeopardises the welfare of the children and the integrity of the nursery’s operations. Examples:

  • Inadequate Supervision of children
  • Neglecting, Phsicaly abusing or Verbally abusing a child
  • Lack of Safety Measures for either Staff or Children
  • Unauthorised Access of Individuals to enter the nursery
  • Medication Errors
  • Failure to Report Incidents
  • Health and Hygiene Violations
  • Unauthorised taking or sharing of Photos and Videos
  • Discrimination or Bias
  • Financial Mismanagement

Maladministration encompasses any actions or practices that lead to a failure to adhere to administrative regulations and requirements. This includes the repetition of errors or the implementation of subpar administrative procedures.

Whistle Blowing #

Staff members have both the right and a personal obligation to bring forward any concerns related to substandard practices in the workplace. Ensuring the safety and well-being of all children attending the Nursery is a primary responsibility that takes precedence over any loyalty to colleagues.

Whistleblowing is the act of reporting unethical, illegal, or wrongful activities within an organisation or company to the appropriate people. Whistleblowers, often employees or insiders, come forward to expose wrongdoing, such as fraud, corruption, safety violations, discrimination, or other forms of misconduct.

Additionally, we have various other policies and procedures that address matters related to discipline, grievances, and complaints. This policy is designed to complement these existing procedures and specifically covers concerns that may not be addressed by those other processes. The company is committed to promptly and comprehensively investigating all concerns raised under this policy and will take the necessary actions accordingly.

Confidentiality #

Occasionally, someone reporting misconduct may prefer to remain anonymous. While it is encouraged to share your identity and contact information with us, if you have concerns about potential negative repercussions, you can request that the Manager keeps your identity confidential.

Management will make every effort to safeguard an individual’s identity when a concern is raised. However, there may be situations where identities need to be disclosed to the person being complained against, or the complainant may be requested to provide written or verbal evidence to support their complaint.

If there’s a need to disclose someone’s identity, they will be informed beforehand, along with the reasons for this necessity. Once concerns have been raised, we expect the complainant not to discuss this matter with anyone else, whether inside or outside the setting.

Anonymous Complaints #

Anonymously expressed concerns are less effective and more challenging to investigate. Nevertheless, we will still consider and examine them.

Although we are willing to investigate anonymously reported issues, our standard practice is to verify an allegation through a separate investigation before addressing it with the individuals concerned.

Untrue Allegations #

If an allegation is made in good faith but is not substantiated by the investigation, no action will be taken against the complainant. However, if an allegation is found to be malicious, appropriate action may be taken against the individual responsible for making the malicious claim.

How To Raise A Concern #

Setting Manager #

If you have a matter you believe is serious in nature your first contact should be your setting manager.

We recommend documenting your concerns in writing, providing background information, history, names, dates, places, and the reasons behind your concern. Timely reporting facilitates a quicker response. If you’d rather not write the allegations yourself, the person handling the complaint will record the details during the interview and request your confirmation by signature.

While you are not expected to prove the truth of your allegations, you should demonstrate that there are reasonable grounds for your concerns.

You should avoid the following actions:

  • Conducting your own investigation
  • Alerting those suspected of being involved or accusing individuals
  • Sharing the information with anyone other than the designated persons, such as the Manager or Director.

You will receive a written acknowledgment of your concern, along with a copy of your statement if applicable, within 10 working days of us receiving your concern.

LADO #

Sharing Information with LADO #

If the matter involves an allegation against a member of staff or volunteer it should be reported to the manager immediately. If the allegation meets the criteria below the manager should download and complete a referral form and send to the LADO (Local Authority Designated Officer) within 24 hours of becoming aware.

This framework for managing allegations should be used in respect of all cases in which it is alleged that a person who works with children has:

  • behaved in a way that has harmed a child, or may have harmed a child;
  • possibly committed a criminal offence against or related to a child; or
  • behaved towards a child or children in a way that indicates s/he would pose a risk of harm if they work regularly or closely with children

Breach of Policy #

Any member of staff, student or volunteer found to be in breach of this policy will be subject to disciplinary action as a breach of this policy and our safeguarding policy. Any breach could result in termination of employment.
